1. Introduction
These Terms and Conditions ("Terms") govern your use of the Runcfg platform and services ("Service") provided by Hypergiant Ltd, a company registered in England and Wales ("Company", "we", "us", or "our").
By accessing or using our Service, you agree to be bound by these Terms. If you disagree with any part of these Terms, you may not access the Service.
2. Definitions
- "Account" means a unique account created for you to access our Service.
- "Service" means the Runcfg feature flag and remote configuration platform, including all related APIs, SDKs, documentation, and support.
- "Subscription" means your paid or free plan that determines your usage limits and available features.
- "User" means the individual or entity that has registered for an Account.
- "Content" means any data, configurations, feature flags, or other materials you upload to or create within the Service.
3. Account Registration and Security
To use our Service, you must create an Account. You agree to:
- Provide accurate, current, and complete information during registration
- Maintain the security of your Account credentials
- Accept responsibility for all activities that occur under your Account
- Notify us immediately of any unauthorised access or security breach
You must be at least 18 years old or the age of legal majority in your jurisdiction to use this Service.
4. Service Description and Availability
Runcfg provides a cloud-based platform for managing feature flags, remote configuration, and encrypted secrets for software applications. The Service includes:
- Feature flag management with boolean, string, and numeric flag types
- Remote configuration storage and delivery in YAML format
- Encrypted secrets storage with RSA-2048 encryption
- Global edge delivery for low-latency access
- SDKs for Go, Rust, and TypeScript
- Usage analytics and monitoring
We aim to maintain 99.9% uptime but do not guarantee uninterrupted access. We reserve the right to modify, suspend, or discontinue any part of the Service with reasonable notice.
5. Subscriptions and Payment
5.1 Subscription Plans
The Service is offered under various subscription tiers, including a free tier with limited usage. Details of each plan's features and limits are available on our pricing page.
5.2 Billing
Paid subscriptions are billed in advance on a monthly or annual basis. All fees are quoted in British Pounds (GBP) and are exclusive of VAT unless otherwise stated.
5.3 Payment Terms
Payment is processed through our third-party payment provider (Stripe). By providing payment information, you authorise us to charge your payment method for all fees due.
5.4 Refunds
Refunds are provided at our discretion. If you are unsatisfied with the Service, contact us within 14 days of your initial subscription for a full refund. This does not affect your statutory rights.
6. Acceptable Use
You agree not to:
- Use the Service for any unlawful purpose or in violation of any applicable laws
- Attempt to gain unauthorised access to any part of the Service or related systems
- Interfere with or disrupt the integrity or performance of the Service
- Transmit malicious code, viruses, or harmful data through the Service
- Use the Service to store or transmit content that infringes third-party rights
- Resell or redistribute the Service without our written consent
- Exceed the usage limits of your subscription plan
- Use automated means to access the Service beyond the intended SDK functionality
7. Intellectual Property
7.1 Our Intellectual Property
The Service, including its original content, features, and functionality, is owned by Hypergiant Ltd and is protected by international copyright, trademark, and other intellectual property laws.
7.2 Your Content
You retain ownership of all Content you upload to the Service. By uploading Content, you grant us a limited licence to store, process, and transmit your Content solely for the purpose of providing the Service.
7.3 Feedback
Any feedback, suggestions, or ideas you provide regarding the Service may be used by us without obligation or compensation to you.
8. Data Protection
We process personal data in accordance with the UK General Data Protection Regulation (UK GDPR) and the Data Protection Act 2018. Our processing of your personal data is governed by our Privacy Policy.
Where you upload personal data to the Service as part of your Content, you are the data controller and we act as a data processor. You are responsible for ensuring you have lawful grounds for processing such data.
9. Confidentiality
We will maintain the confidentiality of your Content and will not access, use, or disclose it except as necessary to provide the Service, comply with law, or with your consent.
Your API credentials (Client ID and Client Secret) are confidential. You are responsible for keeping them secure and must notify us immediately if you believe they have been compromised.
10. Limitation of Liability
To the fullest extent permitted by law:
- The Service is provided "as is" without warranties of any kind, express or implied
- We do not warrant that the Service will be uninterrupted, secure, or error-free
- Our total liability for any claims arising from your use of the Service shall not exceed the amount paid by you for the Service in the 12 months preceding the claim
- We shall not be liable for any indirect, incidental, special, consequential, or punitive damages
Nothing in these Terms limits our liability for death or personal injury caused by our negligence, fraud, or any other liability that cannot be excluded by law.
11. Indemnification
You agree to indemnify and hold harmless Hypergiant Ltd, its officers, directors, employees, and agents from any claims, damages, losses, or expenses (including legal fees) arising from:
- Your use of the Service
- Your violation of these Terms
- Your Content or its use within your applications
- Your violation of any third-party rights
12. Termination
12.1 Termination by You
You may terminate your Account at any time through your account settings or by contacting us. Termination takes effect at the end of your current billing period.
12.2 Termination by Us
We may suspend or terminate your Account immediately if you breach these Terms, fail to pay fees when due, or engage in conduct that we determine is harmful to the Service or other users.
12.3 Effect of Termination
Upon termination, your access to the Service will cease and your Content may be deleted after a reasonable retention period. We will provide you with an opportunity to export your Content before deletion where practicable.
13. Changes to Terms
We may modify these Terms at any time. We will notify you of material changes via email or through the Service at least 30 days before they take effect. Your continued use of the Service after the changes take effect constitutes acceptance of the modified Terms.
14. Governing Law and Disputes
These Terms are governed by and construed in accordance with the laws of England and Wales. Any disputes arising from these Terms or your use of the Service shall be subject to the exclusive jurisdiction of the courts of England and Wales.
Before initiating any legal proceedings, you agree to attempt to resolve disputes informally by contacting us at support@runcfg.com.
15. General Provisions
- Entire Agreement: These Terms constitute the entire agreement between you and us regarding the Service.
- Severability: If any provision of these Terms is found unenforceable, the remaining provisions will continue in effect.
- Waiver: Our failure to enforce any right or provision does not constitute a waiver of that right.
- Assignment: You may not assign your rights under these Terms without our consent. We may assign our rights freely.
- Force Majeure: We are not liable for delays or failures caused by circumstances beyond our reasonable control.
